2. HOW DOES TS ADVISORY B.V. OBTAIN YOUR PERSONAL DATA?
By visiting www.tsadvisory.nl, contacting TS Advisory B.V. or doing business with TS Advisory B.V., you may provide TS Advisory B.V. with Personal Data. This Privacy Statement is applicable to the processing by TS Advisory B.V. of such Personal Data.

3. CATEGORIES OF PERSONAL DATA CONCERNED
The categories of Personal Data collected depend on the relationship you have with TS Advisory B.V. The following categories of personal data may for example be provided:
• Name, gender, title and age / date of birth;
• Nationality;
• Contact details (for example address, telephone number, e-mail (work and/or private));
• Marital status and family composition;
• Business details (organisation, function, names of business relations);
• Financial details (card number, IBAN/bank account number, amount, salary data);
• Administration number(s).

4. FOR WHAT PURPOSES DOES TS ADVISORY B.V. USE YOUR PERSONAL DATA?
Depending upon your (legal) relationship with TS Advisory B.V., your Personal Data may be processed for one or more of the following purposes:

• to ensure proper communication;
• to establish and manage our (potential) relationship with you;
• to properly enter into and perform our agreement(s) with you;
• to provide you with marketing/commercial information;
• to optimize the quality of our services;
• to prevent, detect and investigate fraudulent or criminal activities;
• to carry out recruitment activities;
• to process and assess job applications;
• to carry out business development activities;
• in the context of a (potential) corporate transaction, such as a merger, sale or change of control;
• to establish, exercise or defend TS Advisory’s legal rights;

TS Advisory B.V. will not use your Personal Data for purposes that are incompatible with the purposes of which you have been informed, unless it is required or authorised by law to do so.

5. ON WHAT LEGAL GROUNDS DOES TS ADVISORY B.V. USE YOUR PERSONAL DATA?
TS Advisory B.V. shall use your Personal Data on the basis of one or more of the following legal grounds:

• because the use of your Personal Data is necessary for the conclusion and performance of an agreement with you;
• because the use of your Personal Data is necessary to ensure compliance with its legal obligations;
• because the use of your Personal Data is necessary for the purposes of TS Advisory B.V.’s legitimate interests or those of a third party, and/or;
• because you have consented to the use of your personal data.

TS Advisory B.V. has a legitimate interest in collecting and processing Personal Data, for example, (i) to ensure proper communication with you, (ii) to optimize the quality of its services, (iii) to detect, prevent and investigate fraud and (iv) to enforce its rights and to comply with legal obligations. TS Advisory B.V. will only provide you with direct marketing e-mails (e.g. an e-newsletter) when you are an existing relation or after
it has obtained your prior explicit consent to receive such e-marketing communications. You have the right to object at any time to the processing of your Personal Data for such marketing purposes through the use of the “unsubscribe” link included at the end of a direct marketing e-mail or by contacting TS Advisory B.V. (see contact details included in Section 9 below).

6. HOW DOES TS ADVISORY B.V. SECURE YOUR PERSONAL DATA?
TS Advisory B.V. takes appropriate technical and organisational measures to protect your Personal Data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, and against all other unlawful forms of processing. Examples of such measures are the implementation of a secure IT infrastructure, the conclusion of data processing agreements with third parties and the restriction of access to personal data to authorized persons only.

However, it should be noted that: (i) in general, the transmission of information over the internet is never completely secure, private, or confidential; and (ii) any information that is sent to or received by the TS Advisory B.V. websites may be intercepted, decrypted, consulted, and used by third parties, even if the exchange of such information is encrypted.

7. WHO DOES TS ADVISORY B.V. SHARE YOUR PERSONAL DATA WITH?
TS Advisory B.V. may transfer your personal data to the following categories of recipients:

• service providers (for example IT support providers and cloud computing providers);
• professional advisors (for example lawyers and accountants);
• third parties in connection with a (potential) corporate transaction;
• governmental or administrative authorities;
• financial institutions, and;
• insurance companies.

Such recipients may be located outside the European Economic Area (the “EEA”). Unless otherwise notified to you, any transfers of your personal data to recipients located outside the EEA will be based on an adequacy decision or are governed by
the standard contractual data protection clauses as set forth in clauses 45 and 46 of the GDPR.

8. HOW LONG WILL TS ADVISORY B.V. RETAIN YOUR PERSONAL DATA?
TS Advisory B.V. shall retain your Personal Data only for as long as is necessary for the purposes for which your Personal Data is collected. The criteria TS Advisory B.V. uses to determine the applicable retention period include: the term of your agreement with TS Advisory B.V., the term of your (ongoing) relationship with TS Advisory B.V. and TS Advisory B.V.’s legal and contractual obligations.

9. WHAT ARE YOUR RIGHTS?
As set forth in the GDPR, you have the right to request from TS Advisory B.V. access to and rectification or erasure of your Personal Data or restriction of the processing of your Personal Data or to object to the processing of your Personal Data, as well as the right to data portability.

Where TS Advisory B.V. processes your Personal Data on the basis of your consent you have the right to withdraw your consent at any time. Such withdrawal will not affect the lawfulness of the processing based on consent before its withdrawal.

If you believe that your rights have been violated and/or if you believe that TS Advisory B.V. does not comply with applicable data protection laws, you have the right to lodge a complaint with a supervisory authority.
